Terms of Service

These Terms of Service (“Terms”) govern your use of Agent 18, webagent18.com, and the related WordPress plugin and WhatsApp-based services provided by Blue Cloud Services, Moradabad, Uttar Pradesh, India (“Agent 18,” “we,” “us,” or “our”).

By creating an account, purchasing a subscription, connecting a WordPress site, or using Agent 18, you agree to these Terms and our Privacy Policy. If you use Agent 18 for a business or organization, you confirm that you have authority to accept these Terms on its behalf.

1. The service

Agent 18 helps users manage and monitor WordPress websites through WhatsApp. Features may include answering questions about a site, providing health reports, preparing or carrying out content changes, replacing images, and publishing or unpublishing content.

Features may change as the service develops. We may add, modify, limit, or discontinue features, provided that we will not intentionally remove the essential value of a paid subscription without reasonable notice.

2. Eligibility and accounts

You must be at least 18 years old and legally able to enter into a contract. You must provide accurate account information and keep it updated.

You are responsible for activity under your account and for protecting your login details, WordPress credentials, connection tokens, and WhatsApp access. Notify us promptly at salil@blue-cloud.io if you suspect unauthorized use.

3. Your authority and responsibilities

You confirm that you own, manage, or have permission to connect every WordPress site and WhatsApp number used with Agent 18. You are responsible for:

  • the content and data you provide or make accessible;
  • obtaining any permissions or consents required for that data;
  • keeping suitable website backups;
  • reviewing important AI-generated information and proposed changes;
  • confirming that completed actions are correct; and
  • complying with applicable laws and third-party platform rules.

You grant us a limited right to access and process your content only as needed to provide, secure, support, and improve Agent 18 and to comply with law. You keep ownership of your website content and data.

4. AI and automated actions

Agent 18 uses artificial intelligence. AI output can be inaccurate, incomplete, or unsuitable for your particular circumstances. You should independently review important information and website changes.

Where Agent 18 asks for approval, you are responsible for reviewing the proposed action before approving it. Even when approval is not requested, you remain responsible for monitoring your website and maintaining backups. Agent 18 is not a substitute for legal, financial, medical, security, or other professional advice.

5. Acceptable use

You must not use Agent 18 to:

  • access or modify a website, account, or data without authorization;
  • violate any law or another person’s rights;
  • send spam, deceptive messages, malware, or harmful content;
  • bypass security controls or attempt to discover vulnerabilities;
  • interfere with the service or use it in a way that creates unreasonable risk or load;
  • copy, reverse engineer, resell, or exploit the service except where expressly permitted; or
  • use Agent 18 for high-risk decisions where an error could cause serious harm.

We may investigate suspected misuse and suspend or terminate access where reasonably necessary to protect the service, our users, or others.

6. Third-party services

Agent 18 relies on third-party services, including WordPress, WhatsApp/Meta, OpenAI, PayPal, and hosting or infrastructure providers. Your use of those services may also be governed by their terms and policies.

We are not responsible for third-party outages, restrictions, account suspensions, policy changes, or changes to their APIs. If a third-party change prevents a feature from working, we may modify or discontinue that feature.

7. Fees, billing, and taxes

Subscription fees and billing periods are shown when you purchase a plan. Payments are processed through PayPal. You authorize recurring charges where you select a recurring subscription.

Unless stated otherwise, fees do not include taxes that may apply to you. You are responsible for any applicable taxes, duties, or similar charges, other than taxes based on our income.

We may change prices for future billing periods by providing reasonable notice. Continued use after the new price takes effect means you accept it.

8. Cancellation and refunds

You may cancel your subscription at any time through PayPal or by emailing salil@blue-cloud.io. Cancellation takes effect at the end of the current paid billing period, and you may continue using the paid service until then.

Payments are generally non-refundable, including for unused time, partial billing periods, or failure to use the service, except where a refund is required by law or we expressly agree otherwise.

9. Suspension and termination

You may stop using Agent 18 at any time. We may suspend or terminate your access if you materially breach these Terms, fail to pay fees, create a security or legal risk, or misuse the service. Where practical, we will give you notice and an opportunity to correct the issue.

After termination, your right to use the service ends. You should disconnect the WordPress plugin and remove any Agent 18 credentials or access that you no longer want active. Sections that logically should continue, including payment obligations, ownership, disclaimers, liability limits, and governing law, will survive termination.

10. Our intellectual property

Agent 18, its software, branding, website, and related materials are owned by Blue Cloud Services or its licensors. These Terms give you a limited, non-exclusive, non-transferable right to use the service during your subscription. They do not transfer ownership of Agent 18 to you.

If any part of the WordPress plugin is provided under an open-source licence, that licence controls that part of the software.

11. Service availability and warranties

We aim to keep Agent 18 reliable, but we do not guarantee uninterrupted or error-free operation. The service is provided on an “as is” and “as available” basis to the maximum extent permitted by law.

We disclaim implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that Agent 18 will meet every requirement, prevent every website issue, or produce accurate AI output.

Nothing in these Terms excludes a warranty or right that cannot legally be excluded.

12. Limitation of liability

To the maximum extent permitted by law, Blue Cloud Services will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities arising from your use of Agent 18.

Our total liability for all claims relating to the service will not exceed the amount you paid for Agent 18 during the six months immediately before the event giving rise to the claim.

These limitations do not apply where liability cannot legally be limited or excluded.

13. Changes to these Terms

We may update these Terms as the service or law changes. We will post the updated Terms and revise the “Last updated” date. For material changes, we may provide notice by email, WhatsApp, or through the service. Continued use after the updated Terms take effect means you accept them.

14. Governing law and disputes

These Terms are governed by the laws of India. Courts located in Moradabad, Uttar Pradesh will have exclusive jurisdiction over disputes arising from these Terms or Agent 18, subject to any rights that applicable consumer law does not allow you to waive.

Before filing a formal claim, you agree to contact us at salil@blue-cloud.io and try in good faith to resolve the dispute informally.

15. General terms

If any provision of these Terms is held unenforceable, the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent. We may transfer them as part of a merger, reorganization, or sale of the service or business.

These Terms, together with the Privacy Policy and any plan-specific terms shown at purchase, form the entire agreement between you and Blue Cloud Services regarding Agent 18.
